Separation

Kitchener family law lawyers you can trust to help you move forward towards healing and on to the next chapter in your life.

Our experience assisting families in transition with their separation has taught us that clients cannot start the next chapter in your life, if you keep re-reading the last one. We will help you and your family to move forward with your separation, not by closing the book, but by opening a new chapter. If you are considering a separation or in the process of going through a separation, you will have many questions about the process. For over 40 years, clients have been turning to Sherman Law LLP for assistance in answering many difficult questions: "How should I tell my spouse I want to separate? How will my separation affect my children? Will I have to sell my house?" At Sherman Law LLP, we will answer all of your questions based on the knowledge gained from over 40 years of experience, and the fact there are very few problems that we have not previously helped clients to resolve.

We examine the collateral issues in your case to prevent future disputes.

We take an integrated approach to separation and divorce. We will address all of the collateral issues that may lead to future legal problems – we may review your current retirement plans, estate planning and your child custody arrangements and suggest any required revisions. We then work with you to create a custom plan that accommodates your concerns and objectives. We take pride in our proven ability to deescalate conflict, implement stability, and reach a positive resolution for our clients. Our goal is to make sure you can move forward from your separation and divorce with confidence that you can leave the past behind.

Court is not the only way to resolve your dispute.

We understand that very few clients want to go to court. Our lawyers will assist you in exploring all available alternative options to resolve your dispute in order to avoid litigation including collaborative divorce and mediation. We will help you understand all of the steps of a separation agreement while addressing the related issues specific to your situation, including financial disclosure, child custody and access, spousal support, and property division.

Sometimes, despite using our best negotiation efforts, spouses are unable to come to an agreement on some of the issues. We will then suggest that you bring in a third party mediator to assist you in resolving your dispute through an agreement, which is a more cost-effective manner than going to court.

It is important to have an experienced Kitchener family law lawyer by your side when drafting a separation agreement. At Sherman Law LLP, we will ensure that your concerns, interests and goals are valued and protected during the disclosure process and through negotiations.

Following a separation, you will need to complete a divorce application to obtain a formal divorce. Often, the terms of your separation agreement will become the terms of your divorce settlement. For this reason, it is very important to speak with a knowledgeable lawyer from the very start of your separation.
